LEGAL TERMS AND CONDITIONS OF PARTICIPATION IN THE PROMOTION
1.- COMPANY ORGANISING THE PROMOTION
The Asociación del Barrio de la Estación, with registered office at Avda. de Vizcaya, número 8, 26200 Haro (province of La Rioja) and tax identification number -G 26425066 is organising the prize draw (hereinafter, “the Promotion”) for promotional purposes on a national level, to be carried out over the Internet, exclusively for users on the Iberian Peninsula and of legal age in accordance with the provisions of the section on conditions for participating.
2.-START DATE AND END DATE
The Promotion will start on 11/11/2020 and will end on 23/11/2020.
3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The participation requirements will be as follows:
-Participation will be open to those persons who reside in the Iberian Peninsula and are over 18 years of age.
-Only those people who have a valid profile on social networks Facebook and Instagram and send a photo with a wine belonging to the wineries of the Barrio de la Estación Association with a comment containing the hashtag #BarrioEstación and tagging another valid profile will be able to participate.
– Participants may enter more than once in this promotion.
4.- TERMS AND CONDITIONS OF THE PROMOTION AND PRIZES
1 winner and 1 alternate will be selected. The selection of the winner and the alternate will be made randomly through the Easypromos platform. Easypromos is a platform that guarantees the transparency of the result of the draw and as proof of this it issues a certificate of validity for each of its draws, the result of which is unalterable by the organiser of the draw, and which any participating user can request from the organiser on 27/11/2020.
The winner will receive as a prize: a special case of 6 wines, one from each of the wineries of the Barrio de La Estación Association.
5.- LIMITATIONS
If it becomes evident that any of the participants do not comply with the requirements set out in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
The following persons may not participate in the Promotion: (i) Employees employed by any of the companies and other entities with legal personality linked to El Barrio de La Estación Association, natural persons who participate directly or indirectly in the capital of El Barrio de La Estación . Any other natural person who has participated directly or indirectly in the organisation of this Competition or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).
The prize awarded will not be transferable or subject to change, alteration or compensation at the request of the Participants and may not be exchanged for any other product or money.
The Asociación del Barrio de La Estación reserves the right, in the event of just cause and prior notification in legal form, to make any changes, suspend or extend this Promotion.
The winner will be responsible for any fiscal or tax charges that the acceptance of the prize may entail, as well as any other expenses arising from the promotion that are not expressly assumed by the Asociación del Barrio de La Estación in these Legal Bases.
A period of FIFTEEN (15) calendar days is established from the date of the awarding of the prize, to make any reasoned claim. The Asociación del Barrio de La Estación reserves the right to substitute the prize for another of similar characteristics if necessary.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Nor will comments against an individual that violate the principles of the right to honour, personal and family privacy and self-image be allowed. We shall not be held responsible for any damage caused by the comments made by participants in the Promotion, which at any time may offend the sensibilities of other participants.
7.- EXEMPTION FROM LIABILITY
By way of example, but not limitation, we shall not be held responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor shall we be held responsible for the use made by the participant with regard to the prize obtained from this Promotion, and shall not assume any responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under our control and that affects the normal development of the Competition, we reserve the right to cancel, modify or suspend the same, including the participation website.
8.- FACEBOOK/INSTAGRAM (in case of Facebook/Instagram promotions)
The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Participants release Facebook/Instagram from any and all liability for any damages arising from the promotion.
9.- PROTECTION OF PERSONAL DATA
The company responsible for the processing of your data is the Asociación del Barrio de La Estación, with registered office at Avda. de Vizcaya, number 8, 26200 Haro (province of La Rioja) and CIF -G 26425066.
The Asociación del Barrio de La Estación takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care.
In accordance with the provisions of the applicable data protection regulations, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this competition being included in a file owned by the Asociación del Barrio de La Estación in order to process the participation in the competition and to communicate the prize in the event that he/she is the Winner.
We inform you that your personal contact details will be used for the following purposes:
Participants guarantee that the personal data provided are truthful and are responsible for communicating to the Asociación del Barrio de La Estación, any changes to them. La Asociación del Barrio de la Estación reserves the right to exclude from this promotion any Participant who has provided false information. It is recommended that the utmost care be taken with regard to Data Protection through the use of security tools, and the Asociación del Barrio de la Estación cannot be held responsible for any unlawful theft, modification or loss of data.
Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability.
Participants may exercise all these rights at the following email address info@lacatadelbarriodelaestacion.com indicating the reason for their request.
Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in the event that the exercise of his/her rights is not satisfied.
The Supervisory Authority with which the complaint has been lodged will inform the complainant of the course and outcome of the complaint.
10.- CHANGES
We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion.
11.- APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of Logroño (La Rioja) shall be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
